Terms of use
Last updated: [date]
Draft for legal review. These terms are a starting point, not legal advice. Have a lawyer licensed in Ontario (and in Quebec, if you serve families there) review them, fill in the highlighted details, and remove this notice before launch.
1. About these terms
These terms of use (the “Terms”) apply to your use of the Napmap website at napmap.ca and any related services (together, “Napmap”). Napmap is operated by [legal entity name], [business address] (“Napmap”, “we”, “us” or “our”). By using Napmap, you agree to these Terms. If you don’t agree, please don’t use Napmap.
2. Napmap is in preview
Napmap hasn’t launched yet. While we’re in preview:
- The daycares shown are sample listings created for demonstration. They aren’t real businesses, and their fees, openings, hours and other details are not real.
- Requests and waitlist sign-ups you make in the preview are not sent to any provider.
- Features may change, stop working or be removed without notice.
3. What Napmap is, and what it isn’t
Napmap is a search and listing service that helps parents and guardians find childcare and contact providers. We are not a childcare provider. We don’t employ, train, supervise, license or inspect childcare providers or their staff, and we aren’t a party to any arrangement you make with a provider. Any agreement for childcare is between you and the provider.
4. Choosing care is your decision
You are responsible for deciding whether a provider is right for your child. Before you make an arrangement, we strongly encourage you to:
- check the provider’s licence status with the Province of Ontario, or with the relevant authority where you live;
- visit in person, meet the caregivers and ask about safety, staffing and emergency plans;
- ask for and check references;
- confirm fees, hours, funding programs and policies directly with the provider, in writing.
5. Listing information
Listing details come from providers or other sources and can change at any time. We don’t guarantee that any listing is accurate, complete or current, including information about openings, fees, licensing, government funding, hours, meals or languages. A listing on Napmap is not an endorsement or recommendation.
6. Your account and requests
You must be at least 18 years old, or the age of majority where you live, to create an account or send a request. You agree to give accurate information, keep your login details secure, and tell us if you think your account has been used without your permission. Only share information about a child if you are their parent or legal guardian, or have their permission.
7. Providers
When provider listings open, providers who list on Napmap are responsible for the accuracy of their listings and for complying with all laws that apply to them, including childcare licensing, health and safety, privacy, and human rights laws. We may refuse, edit or remove any listing, or suspend any provider, at our discretion. Additional provider terms may apply.
8. Acceptable use
When using Napmap, you agree not to:
- give false or misleading information, or pretend to be someone else;
- harass, threaten or discriminate against anyone;
- post information or images about a child without the consent of their parent or guardian;
- copy, scrape or collect data from Napmap by automated means without our written permission;
- interfere with Napmap’s security or operation, or try to access accounts or data that aren’t yours;
- use Napmap for any unlawful purpose or to send spam.
9. Content you submit
You keep ownership of the content you submit, such as messages, reviews or listing details. You give us a non-exclusive, royalty-free licence to host, display and share that content as needed to operate and improve Napmap. You confirm you have the right to share it.
10. Privacy
We handle personal information in line with Canada’s Personal Information Protection and Electronic Documents Act and other applicable privacy laws. Our privacy policy explains what we collect, how we use it and the choices you have.
11. Our content and brand
The Napmap name, logo, design and content (other than content submitted by users and providers) belong to us or our licensors. You may not use them without our written permission.
12. No warranty
Napmap is provided “as is” and “as available”. To the extent permitted by law, we make no warranties of any kind, express or implied, about Napmap or any listing, and we don’t promise that Napmap will be uninterrupted or error-free.
13. Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss arising from your dealings with a provider, a parent or another user. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived, including Ontario’s Consumer Protection Act and Quebec’s Consumer Protection Act.
14. Changes
We may update Napmap and these Terms from time to time. If we make significant changes, we’ll post the new Terms on this page and update the date at the top. Continuing to use Napmap after changes take effect means you accept them.
15. Ending your use
You can stop using Napmap at any time. We may suspend or end your access if you break these Terms or if we need to protect users, providers or Napmap.
16. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you live in another province, including Quebec, you also keep any protections that the laws of your province give you.
17. Language
These Terms are available in English and in French. Both versions have equal value. Lire les conditions en français.
